Conseil d’État, 17 June 2026, No. 513099 — The presumption of urgency provided for in Article L. 600-3 of the Planning Code for the interim suspension of a refusal to grant a building permit or an objection to a prior declaration also applies to the withdrawal of a building permit that has already been granted: for the applicant, withdrawal amounts to being deprived of the authorisation necessary to carry out their project. This presumption remains rebuttable, however, as the administration may establish particular circumstances precluding suspension, to be assessed concretely by the interim relief judge in light of, in particular, the nature of the project and the public interest invoked.
