Conseil d’État, 20 May 2026, No. 497687 — The Conseil d’État quashes a ruling of the administrative court of appeal that had upheld the administration’s withdrawal of a building permit granted to an SCCV (real estate development company) for a mixed-use project of more than 7,000 m² (senior residence and residential building). This decision illustrates the litigation risks specific to off-plan sales (VEFA): withdrawal or annulment of the permit during the course of a project gives rise to cascading difficulties — adjustments to the construction schedule, the regularity of capital calls, completion guarantees, and buyer information — which developers and their advisors must anticipate contractually.
